The shared-property manager's powers and the budget

The association's bylaws choose the shared-property manager and the regulation defines the manager's powers. The key rule is that spending comes only from the budget the general assembly has approved, and the manager's decisions and contracts need the Authority's approval under the regulation.

Who it applies to

Managers of the shared property of an owners' association or complex, association members, and providers contracting with an association.

What the source says

The manager is chosen from among the owners or from outside, according to the bylaws. The association is bound by the manager's acts made in its name and within its purposes. The manager may delegate in writing and is liable for harm caused by breaching duties (law, article 19; regulation 21). An owner who built the property may appoint the manager alone on conditions: keeping at least 10% of the units, having no fewer than 100 separate units, and any further conditions the Authority adds (regulation 22; law 19/4).

Article 23 sets out the powers: providing services, collecting contributions, paying out approved funds and representing the association. Spending may come only from the approved budget (23/3). The manager prepares the draft annual budget and puts it to the general assembly for approval (law 20/1), and the financial statements and report are prepared within three months of the financial year end (20/3).

The manager's decisions and contracts need the Authority's approval (regulation 24); neither the manager nor relatives up to the fourth degree may have a direct interest in them, and once approved they serve as an enforceable instrument (law 21). The manager owes a duty of honesty and must avoid conflicts of interest (25), and the Authority may notify the manager of a shortfall and set a deadline to correct it (26). Article 30 allows a reserve, by general assembly decision, to cover spending above the budget.

When it matters to you

If you sit on an association or manage one, this text shows that every payment needs a basis in an approved budget and that significant contracts are not complete on the manager's signature alone. If you are a provider quoting to an association, ask which budget line the payment will come from and who holds the authority to sign. Registration and approval take place on Mullak.

What this article does not cover

The text sets no fixed monetary limit; limits come from the approved budget and from each association's bylaws. This is general information from a published source, not legal advice; official decisions and procedures take place on the authority's platform.
