Who it applies to

Association chairs and members, managers of shared properties and those who prepare their meetings.

The meeting and the majority

An association must be formed and registered once the owners of divided units number three or more (article 12 of the law). The general assembly meets once a year in the three months after the end of the financial year (law 18/4). Its decisions are valid with the approval of owners representing at least three quarters of the area of the divided units, unless the bylaws raise the ratio (law 18/6). If one owner's share exceeds half, that owner's votes are reduced to half. The chair is elected for three years, renewable (law 18/3).

What the assembly considers

The first general assembly considers and adopts the bylaws (regulation 15/2(a)). The manager prepares the draft annual budget and presents it to the assembly for approval (law 20/1), and the financial statements and the report are prepared within three months of the end of the financial year (law 20/3). Each owner pays for shared service meters what the general assembly decides (regulation 37).

How to prepare for the meeting

Before the meeting, assemble the registered bylaws, a statement of unit areas, the proposed budget, and the service proposals to be decided. Draft the items in a paper sent to owners in advance, and record what was decided and its decision reference. Compare the ratio in your own association's bylaws with the general ratio before treating any decision as valid.

Thibrh's role, its limits and what you need from an official body and what this article does not cover

Thibrh helps prepare meeting items and gather and compare proposals in a preparatory way, but it neither counts a quorum or votes nor presents a decision as issued; the decision is taken and approved on Mullak. Each association's bylaws may add provisions, so refer to its registered version. This is general information from a published source, not legal advice; official decisions and procedures take place on the authority's platform.
